General


We are looking for a qualified Trading Stanadrds Officer to join our East London local authority client on a long term basis

 

Main Purpose of the Job / Key Objectives:

 

The enforcement of all Trading Standards legislation within the Borough (Weights & Measures only if DTS or MCATS qualified).

 

To give legal advice and support promoting compliance with the law through education, investigating complaints and checking the quality of goods and services.

 

Subject to qualification and competence, to specialise in a piece of legislation, and/or an area of work and to lead a team of officers on an investigation

 

Subject to qualification and competence, to oversee less experienced officers during case work.

 

The post is subject to a career grade with progression through the grade subject to the achievement of qualification and competence – as defined in appendix 1.

 

Job Context:

 

The post holder reports to the Trading Standards Specialist.

 

The post holder will occasionally be required to work outside ‘normal’ office hours

 

The post holder may occasionally be required to assist in the supervision of trainee officers, work experience candidates and volunteers involved in test purchasing exercises.

 

Subject to qualification and competence the postholder maybe expected to oversee the workloads of, and allocation of work to, other members of staff.

 

Experience

 

Experience of dealing with the public as clients of a service is desirable at any level of appointment to this post.

 

Experience in the following areas is desirable only for appointment at higher grades:

 

Mentoring more junior staff to ensure compliance

 

Effective negotiation with businesses to help achieve resolution of fair trading complaints

 

Enforcing and promoting compliance with trading standards related criminal law.

 

Carrying out programmes of work to required standards both qualitatively and quantitatively

 

Effective enforcement experience across a range of functions including investigating, collecting evidence, preparing cases and giving evidence in court.

 

Writing reports for committees, other Services of the Council and relevant external agencies

 

Implementing Action Plans and contributing to business planning

 

Dealing with politically sensitive and contentious matters

 

Qualifications

 

TSQF qualification

 

The Trading Standards Qualifications Framework (TSQF) delivered by the Trading Standards Institute provides a modern qualification framework for all staff delivering trading standards services.

 

There are five levels of qualification within the framework (plus the Higher Certificate for existing professionals?)

 

Certificate of Competence

 

Core Skills Certificate in Consumer Affairs and Trading Standards (CSCATS)

 

Module Certificate in Consumer Affairs and Trading Standards        (MCATS)

 

Diploma in Consumer Affairs and Trading Standards                   (DCATS)

 

Higher Diploma in Consumer Affairs and Trading Standards           (HDCATS)

 

Higher Certificate in Consumer affairs and Trading Standards          (HCCATS)

 

The framework is modular, each module consisting of both examinations and assessment of a portfolio of evidence demonstrating competency in practical work.

 

A required pass level in a recognised degree will provide exemption from most if not all examinations - there is an exemption procedure.

 

Core Skills Certificate in Consumer Affairs and Trading Standards (CSCATS), or Diploma in Consumer Affairs (DCA) Part 1, or a degree in a relevant subject (e.g. Law) (if appointed above scale S01)

 

Module Certificate in Consumer Affairs and Trading Standards (MCATS) (any module) or Diploma in Consumer Affairs (DCA) Part 2, or Consumer Protection degree. (if appointed above scale S02)

 

Module Certificate in Consumer Affairs and Trading Standards (MCATS) with (metrology module) if to be appointed as a Weights and Measures Inspector.

 

 Module Certificate in Consumer Affairs and Trading Standards (MCATS) (with any two modules) or Diploma in Consumer Affairs and Trading Standards (DCATS) or Diploma in Trading Standards (DTS) (or equivalent) (if appointed above scale P01)

 

Working conditions/circumstances

 

Ability to adapt working hours to meet job requirements e.g. evening Committee meetings in different locations.

 

Evening and weekend call-out availability.

 

A current full driving licence

 

Key Accountabilities and Result Areas:

 

To be responsible to the Trading Standards Specialist for the efficient and cost effective performance of assigned duties. Trading Standards team runs effectively and efficiently

 

To be responsible to the Trading Standards Specialist for the efficient and cost effective running of Trading Standards activities and projects            Trading Standards team runs effectively and efficiently.

 

Projects and activities completed to departmental/professional standards.

 

Have a sound working knowledge of relevant legislation and appeal cases enabling the post holder to advise businesses, consumers and other Council Departments/organisations 

 

Advice and information given in all cases is accurate, consistent and up to date.

 

To carry out investigations and resulting interviews in accordance with legislative requirements and office procedures with the aim of detecting and preventing crime.

 

Investigations and associated legal reports comply fully with legal requirements and Council and Departmental policies and procedures and best practice.

 

To participate in and, where appropriate, organise enforcement projects around specific issues – such as the control of sale of age restricted products. Effective regulation and achievement of specific service goals and performance targets.

 

Liaise and consult with other Council services and Central Government Departments on matters relating to the Trading Standards Service.

 

The Council is represented in respect of trading standards issues and acts in accordance with the latest information and intelligence.

 

Depending on grade and competence to co-ordinate the enforcement of specialist legislation as allocated in procedures. Ability to act as service expert in an agreed area of legislation.

 

Liaise/consult with Government departments, local police and other organisations on matters appertaining to the work of the Service.  Good, practical working relationships with partner agencies are maintained to achieve planned service and public sector outcomes.

 

Ensure allocated complaints are effectively dealt with in accordance with office procedures.     All complaints allocated are investigated and completed in a professional, timely manner and to agreed departmental standards.

 

Prepare detailed reports where offences are detected and to submit these to the Trading Standards Specialist or Trading Standards Manager within the timescales laid down. Make recommendations as to the most appropriate course of action.

 

Effective regulation, compliant with the Council’s Enforcement Policy.

 

Legally compliant investigation reports capable of supporting legal action.

 

Attend Magistrates’, Crown and County Courts and other hearings and tribunals as a witness in relation to criminal proceedings/civil actions as required, and at other times as directed.   

 

Effective regulation and successful enforcement action where appropriate.

 

Identify unfair Trading Standards practices and advise the Trading Standards Specialist where appropriate   

 

Effective regulation and promotion of Fair Trading.

 

Intelligence based enforcement policy.

 

Carry out the duties of a ‘Home Authority’ or ‘Primary Authority’ Officer for allocated companies/businesses      

 

Successful relationships developed with locals businesses.

 

Assist in the maintenance and operation of APP and other software systems including the collation of data for formal returns.       

 

Records of service activities are accurate and complete.

 

Assist in the training of staff, businesses and other organisations as appropriate

 

Training events are successful

 

Properly trained workforce

 

The post holder will occasionally be responsible for the receipt and disposal of cheques, cash etc            Cash receipts correctly accounted for.
